Terms of Service — Costante

1. Agreement and eligibility

These Terms of Service ("Terms") govern your use of the Costante app and the www.costante.app website (together, the "Service"). Costante is operated by Beckham Huang, an individual based in Taiwan. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to enter into these Terms to use Costante.

2. Accounts

You are responsible for activity under your account. Keep your credentials confidential and provide accurate account information. You may sign in with email and password, Apple, or Google; Apple and Google sign-in are also subject to their respective terms.

3. The Costante service

Costante is behavioral trading-performance software. It supports trade planning and review, behavioral performance review, guardrails, discipline tracking, behavioral analytics, and trading-performance analytics. You may record trade and behavioral information so that Costante can calculate metrics, guardrail evaluations, and insights based on what you enter.

4. No brokerage, trade execution, or financial advice

Costante is not a broker-dealer, broker, exchange, trading platform, financial institution, or investment adviser. It does not connect to brokers or exchanges; execute, route, or transmit orders; provide brokerage or exchange services; or provide trade signals. It does not automatically block brokerage orders or provide broker-level trade locking.

Costante's outputs are calculations based on information you enter. They are not recommendations to buy, sell, hold, or trade any instrument and are not financial, investment, legal, or tax advice. Seek advice from a qualified professional where appropriate.

5. Trading risk and responsibility

Trading involves substantial risk of loss and may not be suitable for everyone. You are solely responsible for your trading decisions and outcomes. Costante does not guarantee trading performance, discipline, profitability, or any particular result. Guardrails support review and discipline tracking; they do not physically prevent brokerage execution.

6. Subscriptions and billing

Costante may offer auto-renewable subscriptions through the Apple App Store. The current price, billing period, and subscription features are shown before purchase. Any trial or introductory offer is subject to eligibility determined through the App Store and RevenueCat integration.

Payment is processed by the App Store. Subscription renewals are controlled according to Apple's subscription terms. You can manage or cancel an active subscription through your Apple Account subscription settings. Restore Purchases is supported where applicable. Deleting your Costante account does not cancel an active App Store subscription.

7. Your content

"Your Content" means the information you enter into Costante, including trade records, behavioral inputs, settings, and feedback. You retain ownership of Your Content.

You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, analyze, display, transmit, and back up Your Content only to operate, secure, maintain, and improve the Service for you. This license ends when Your Content is deleted from active Costante systems, except for limited copies and records retained under the Privacy Policy.

8. Acceptable use

You agree not to:

use the Service unlawfully or in breach of these Terms;
access or attempt to access another person's account or data;
disrupt, overload, probe, or interfere with the Service or its infrastructure;
reverse engineer or attempt to extract source code except where law permits despite this restriction;
scrape or bulk-extract data from the Service;
resell or sublicense the Service; or
present Costante outputs as investment advice or trade signals, or use the Service to advise others.

9. Intellectual property

The Service, including its application, website, design, branding, software, and presentation of metrics, is owned by us or our licensors and protected by applicable intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service on your devices for your own use under these Terms. All rights not expressly granted are reserved.

10. Third-party services

The Service uses Supabase for authentication, database, and backend functions; Apple for App Store billing, subscription management, and Sign in with Apple where selected; Google for authentication where selected; RevenueCat for subscription and entitlement integration; and Resend for support-feedback email delivery. Those services may be subject to their own terms and privacy policies.

11. Availability and termination

Costante is software in active development. Features and availability may change over time. We do not guarantee uninterrupted access and the Service may be unavailable during maintenance, updates, or events outside our control. Keep independent records of information important to you.

You may stop using Costante at any time and can initiate account deletion in the app. We may suspend or terminate access if you materially breach these Terms, where required by law, or where continued access creates a security or legal risk. Provisions that by their nature should survive termination will do so.

12. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy or completeness of outputs. Nothing in these Terms excludes rights or warranties that cannot be excluded under applicable law.

13. Limitation of liability

To the maximum extent permitted by law, Costante's total liability for claims arising from or relating to the Service will not exceed the amount you paid for the Service during the twelve months before the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or trading losses, to the extent the law permits their exclusion. These limitations do not affect mandatory consumer rights that apply to you.

14. General terms and contact

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. We may update these Terms as the Service changes; if we make material changes, we will revise the Last updated date and may provide notice through the app or website.

These Terms are governed by the laws of Taiwan, excluding conflict-of-laws rules, except where mandatory consumer-protection law in your location applies. Questions about these Terms may be sent to [email protected].
